Your goal should be to obtain an unequivocal response as to whether an individual is entitled to the protections of the Servicemembers Civil Relief Act ("SCRA"). There are several resources available to you:

Regular Mail You may write a letter to each of the 7 military agencies (Army, Navy, Air Force, Marine Corps ("Marines"), Coast Guard, National Oceanic and Atmospheric Administration ("NOAA"), and Public Health Service) including a check for $5.20 to each (total cost is $36.40). You will need to keep track of agency responses and the response time of some agencies is up to 5 months.

Online With This Site This site is a Centralized Search Service ("SCRACVS") to conduct online searches. The cost is the same ($36.40 and an affidavit is available for an additional $15) and the turnaround time is usually one to two business days. The search usually may be conducted with or WITHOUT a social security number ("SSN"). The SSN is the best information, but, If no SSN is available, you may supply alternate information, such as addresses or date of birth ("d.o.b.").

Online With Other Resources While there are other online resources, they lack the tracking ability of the SCRACVS and, if you are unable to supply an SSN, you may receive an equivocal response such as "we confirm that the individual is not on active military duty BUT, because you did not supply a SSN, we cannot guaranty that we have searched the correct individual because the SSN is the only unique identifier we use". No one should want to run the risk of violating the SCRA based upon an equivocal response. The SCRACVS does NOT qualify its responses. Instead, the SCRACVS gives solid, unequivocal responses, regardless of whether you have been able to supply an SSN.

The Servicemembers Civil Relief Act ("SCRA", successor to the Soldiers and Sailors Relief Act) accords certain protections and rights to individuals who are either on active military duty or recently retired. The purpose of the Act is to allow the servicemembers to perform their valuable duties without the worry of civil prosecution, foreclosure or eviction under most circumstances. Before a court will permit such actions, the court will require certification that a military search has been conducted to confirm that the individual is not entitled to the protections of the Act. Proof of that search is often in the form of a military affidavit, "non-military affidavit", or "nonmilitary affidavit".
The Servicemembers Civil Relief Act Centralized Verification Service (SCRACVS) is available on-line and permits SCRA searches even if no social security number or date of birth of the individual is available. In addition, SCRACVS provides full tracking, covers recently retired personnel, and provides unequivocal responses. The Defense Manpower Data Center (DMDC or DMDC.osd) is more limited as a resource because it is unable to conduct an unequivocal active duty military search unless a Social Security Number (SSN) is provided. If a d.o.b. alon e is provided, the DMDC will issue a strong disclaimer indicating that the military certification is not guaranteed if no SSN was provided. Some courts will not accept a response with such a disclaimer. The SCRACVS response generally does not include this disclaimer.
